A visit to our website can result in the storage on our server of information about the access (date, time, page accessed). This does not represent any analysis of personal data (e.g., name, address or e-mail address). If personal data are collected, this only occurs – to the extent possible – with the prior consent of the user of the website. Terms of Use for the Knowledge Repository

Description

The Lake Victoria Challenge supports the free online communication and exchange of knowledge as the most effective way of ensuring that the fruits of research, economic and sector work, and development practice are made widely available, read, and built upon. The Lake Victoria Challenge is committed to open access, which, consistent with the access to information policies of The Lake Victoria Challenge’s member institutions, enables the widest possible dissemination of their findings and, for researchers, readers, and users, increases their ability to discover pertinent information.

For purposes of these Terms of Use for Knowledge Repository (“Terms of Use”), “The Lake Victoria Challenge” means any or all of its member institutions, as the context may require. The member institutions of The Lake Victoria Challenge are separate legal entities and are severally (but not jointly) liable for their respective obligations hereunder.

Intellectual Property Rights – Licenses

You are encouraged to use the Knowledge Repository to benefit yourself and others in creative ways. By using this website and any of the materials made available through the Knowledge Repository (the “Works”), you agree to be bound by these Terms of Use.

You are permitted to use the Works, subject to your compliance with certain license terms, but the relevant member institution(s) still retains the copyright to all of the Works in the Knowledge Repository, unless specifically noted to the contrary.

The majority of Works in the Knowledge Repository are licensed under one of the following public licenses: (1) the Creative Commons Attribution 3.0 IGO (CC BY 3.0 IGO) or (2) the Creative Commons Attribution Non-Commercial No Derivatives 3.0 IGO (CC BY-NC-ND 3.0 IGO).

Some Works within the Knowledge Repository are not subject to the CC BY 3.0 IGO or CC BY-NC-ND 3.0 IGO licenses but are available under other license terms.

Third Party Content

In general, no matter what license applies to each particular Work, the member institutions of The Lake Victoria Challenge do not necessarily own each component of the content included in the Works. The Lake Victoria Challenge therefore does not warrant that the use of any third-party-owned individual component or part contained in the Knowledge Repository will not infringe on the rights of third parties. The risk of claims resulting from such infringement rests solely with you. If you wish to re-use a component of the Work, it is your responsibility to determine whether permission is needed for that re-use and to obtain permission from the copyright owner.

Unless you have a specific written agreement with the relevant member institution(s) of The Lake Victoria Challenge to the contrary, if you use a Work from the Knowledge Repository under CC BY or any other license that permits you to make translations, you must add (after the attribution language) the following explanation to any translation that you create:

“This translation was not created by any member institution of The Lake Victoria Challenge and should not be considered an official World Bank Group translation. No member institution of The Lake Victoria Challenge shall be liable for any content or error in this translation.”

Adaptations of Lake Victoria Challenge Works

The Lake Victoria Challenge retains all rights to prosecute, to the fullest extent of the law, any use of its Works in a manner that falsifies, misrepresents, disparages or fraudulently uses the Works, infringes the intellectual property rights of any third party, or disparages or harms the reputation of The Lake Victoria Challenge.

No Association, No Use of Lake Victoria Challenge and Name

You may not use any trademark, official mark, official emblem, or logo of The Lake Victoria Challenge or any of its member institutions, or any of its other means of promotion or publicity, without The Lake Victoria Challenge’s prior written consent or in any event to represent or imply an association or affiliation with The Lake Victoria Challenge.

These Terms of Use may be amended by The Lake Victoria Challenge from time to time at our sole discretion. Upon amendment, we will place a notice on http://www.lakevictoriachallenge.org/privacy-policy. Please periodically review the controlling version of these Terms of Use. By continuing to use the Knowledge Repository subsequent to The Lake Victoria Challenge making available an amended version of these Terms of Use, you acknowledge, agree and consent to such amendment.

The Lake Victoria Challenge offers other websites, services and databases that are governed by different terms of use, as stated in the terms and conditions specific to such websites, services and databases. Please review the applicable terms of use before using any websites, services and databases provided or made available by The Lake Victoria Challenge. Please note that failure to comply with these Terms of Use, or with the license terms applicable to any Work, including proper attribution format or retaining copyright notices as required, may be grounds for The Lake Victoria Challenge to restrict or prohibit your access to the Knowledge Repository. No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended, entered, or created by these Terms of Use.

Nothing herein shall constitute or be considered to be a limitation upon or waiver of the privileges and immunities of any member institution of The Lake Victoria Challenge, all of which are specifically reserved. Any dispute between The Lake Victoria Challenge and you arising out of, or in connection with, the Knowledge Repository, the Works, or your use of the Knowledge Repository which cannot be amicably settled between the parties to such dispute shall be arbitrated in accordance with the UNCITRAL Arbitration Rules as then in force. The arbitral tribunal shall consist of a sole arbitrator and the language of the proceedings shall be English. The arbitration shall take place in the United States of America. The arbitral proceedings shall be conducted remotely (e.g., via telephone conference or written submissions) whenever practicable. Any resulting arbitration decision shall be final and binding on both parties.
